Cool Collective: Warriors of Future (Cool Collective: WoF) is a collection of digital artworks (NFTs) running on the Ethereum network. This website is only an interface allowing participants to exchange digital collectibles. Users are entirely responsible for the security, integrity and management of their own private Ethereum wallets and digital assets and the due diligence and validation of all transactions and contracts via this website. Please note that it is not possible to undo, reverse, or restore any transactions. This website and its connected services are provided “as is” and “as available” without warranty of any kind, either express or implied, including without limitation, the implied warranties of merchantability or fitness for a particular purpose. We ONE COOL GROUP reserve the right to revise, modify or change these terms and conditions with immediate effect from time to time. By using this website, you accept all the terms and conditions herein and accept sole responsibility for any and all transactions involving Cool Collective: WoF digital collectibles.OWNERSHIP
i. You Own the NFT.Each “Cool Collective: WoF” NFT is an NFT on the Ethereum blockchain. When you purchase such NFT, you own it completely as your personal property for your personal possession and enjoyment. Ownership of the NFT and your activities concerning the NFT is mediated and regulated entirely by these terms and conditions (collectively “Terms”), the Smart Contract and the Ethereum Network.ii. Usage. Subject to your continued compliance with these Terms, ONE COOL GROUP grants you a worldwide, royalty-free and personal license to use, copy, and display the purchased Art in the NFT, solely for the following purposes: (i) for your own personal, non-commercial use; (ii) as part of a marketplace that permits the purchase and sale of your NFT, provided that the marketplace cryptographically verifies each NFT owner’s rights to display the Art for their artwork to ensure that only the actual owner can display the Art; or (iii) as part of a third-party website or application that permits the inclusion, involvement, or participation of your NFT, provided that the website/application cryptographically verifies each NFT owner’s rights to display the Art for their NFT to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the “Cool Collective: WoF” leaves the website/application.
USER ACKNOWLEDGMENT AND ACCEPTANCE
i. ONE COOL GROUP provides the service ("service") which offers you ("user") the opportunity to purchase and transact Cool Collective: WoF on this Cool Collective: WoF website ("website") in accordance with these Terms.ii. When you purchase Cool Collective: WoF displayed on the website through various cryptocurrency electronic wallets ("e-wallets"), you also agree to abide by the e-wallets' terms and conditions of use, privacy policy and related regulations when you match transactions through the website.iii. You shall indemnify, defend and hold ONE COOL GROUP harmless from and against all losses, liabilities, damages and expenses (including legal fees and costs) that may be suffered as a result of any claims, demands, actions or other proceedings arising out of or relating to any breach of these Rules by you.iv. For your rights protection, please read the provisions of these Terms thoroughly. Where applicable, certain aspects of our services may be subject to specific or additional terms and conditions and you should familiarize yourself with them.YOU UNDERSTAND AND ACCEPT THAT YOU ARE PROHIBITED FROM ANY OF THE FOLLOWING ACTIVITIES
i. To copyright or trademark or apply to copyright or trademark the purchased Art or any adaptation thereof, or otherwise acquire intellectual property rights therein. All intellectual property rights in the purchased Art remain absolutely with ONE COOL GROUP and owner of the NFT minted with such Art only enjoys a worldwide, royalty-free and personal license set out in these Terms.ii. Use the artwork or Cool Collective: WoF in connection with images of hatred, violence, blasphemy, discrimination, harassment, other inappropriate behavior, or illegal activities.iii. (i) Damage, undermine, violate or interfere with the integrity of our website and/or our service; (ii) bring any virus or component which may affect, damage or impair the functionality of the website or our service; (iii) cause any erosion, distortion or interference of data or information in our system; (iv) annoy, abuse, threaten, intimidate, harass or deceive any other user of our service; or (v) otherwise conduct any illegal activity via our website.DISCLAIMERS
i. We do not accept any legal responsibility for your conduct on or through this website.ii. You accept that ONE COOL GROUP does not assume liability for any loss, whether direct or indirect, suffered by you or any user for loss or damage arising from any failure, disruption, malfunction, breakdown or error of any facilities used or employed by or relating to the service, howsoever caused.iii. ONE COOL GROUP reserves the right to modify, suspend, or permanently discontinue the service, in whole or in part, at any time without notice. You understand and agree that ONE COOL GROUP shall not be liable for any such changes.DISPUTES
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong") and the parties hereto submit to the non-exclusive jurisdiction of the courts of Hong Kong in the determination of any dispute arising hereunder. Notwithstanding the foregoing, ONE COOL GROUP may refer any dispute, controversy, difference or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it to and finally be resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one and the arbitration proceedings shall be conducted in English.The World is at risk
